In Texas, a DUI is for drivers under 21, while a DWI is for drivers 21 and olderBoth terms refer to driving while intoxicated. 
 
DUI
  • Applies to drivers under 21 with any detectable alcohol in their system 
     
  • Can also apply to drivers under 21 who are impaired by drugs 
     
DWI
  • Applies to drivers 21 and older with a blood alcohol concentration (BAC) of 0.08% or higher 
     
  • Can also apply to drivers who are impaired by drugs 
     
Penalties 
  • Both DUI and DWI can result in driver's license suspension
  • DWI is generally considered more severe than DUI
  • DWI can result in longer jail sentences, longer license suspensions, and higher fines
  • DWI can result in permanent criminal conviction
Other consequences 
 
  • Loss of professional licensure
  • Employment difficulties
  • Loss of firearms
  • Loss of voting rights
  • Child custody issues
  • Difficulty finding housing
  • Difficulty securing a loan
