🧐 Myth or fact: You must always take a breathalyzer test. (It's a myth!)🍺

    • No, you don't always have to take a breathalyzer test in Texas, but there are consequences for refusing: 

      • Implied consent - Texas is an implied consent state, meaning that drivers consent to a breath or blood test if arrested for a DWI.

      • Police may obtain a sample - In some circumstances, police can take a breath or blood sample without your consent.

      • In some cases, a judge may order an ignition interlock for repeat offenders or first-time offenders with a blood alcohol concentration of .15 g/dL or greater. The interlock will stay on the vehicle for up to one year.
